Arresting officers considered the tow truck a deadly weapon “due to it having the capacity to cause death or serious injury…”
Waco, TX – October 17, 2025 – She claims that he had said he would release her car from the tow truck. But as she stepped out of it, the repossession agent allegedly hit the gas. Struck by the car door as he fled, the woman claimed injury and the police agreed and have charged the man with aggravated assault with a deadly weapon.
According to an arrest warrant, on Friday October 17th, 51-year-old Gerald Patterson was at the 2400 block of Marketplace Drive conducting a repossession on a vehicle for his named employer, Rapid Recovery and Towing.
Police report that Patterson was in the process of repossessing a car while an unnamed woman was inside it. Whether or not she was in it when he first lifted it is not reported.
The woman reportedly “stepped out of her car in belief that Patterson was going to release her vehicle due to him making a statement that he would.”
In the arrest warrant, police reported that once the woman got out of the car, Patterson drove away. In the process, “the woman was struck in her arm while attempting to re-enter her vehicle, causing her injury,” police reported.
Patterson was placed under arrest “due to him attempting to drive away recklessly causing injury to the female with his tow truck,” according to the warrant.
Arresting officers considered the tow truck a deadly weapon “due to it having the capacity to cause death or serious injury in the manner in which it was used,” the arrest warrant further claims.

In addition to this serious charge, Patterson was also charged with an enhanced charge, unlawful carrying of a weapon. This was due to his being armed with a pistol while in the “commission of a crime,” police reported.
Patterson was booked into the McLennan County Jail and was being held on $12,000 in bonds.
