Borrower Swings at Cops During Repossession

Bendersville, PA – January 4, 2022 – Screaming and yelling at the officers who’d arrived over a dispute of a repossession in progress, an Aspers man, crossed the line. It didn’t go well.

It was about 5:56 in the afternoon on December 28th when Bendersville Police Officer Alexander Babik and Constable Fitting arrived at an incident involving “a dispute regarding a vehicle repo” on Park Street, according to Babik’s affidavit of probable cause.

Upon arrival, the officers found “a white tow truck parked in front of the residence with a vehicle on the hook,” as stated in their affidavit. It was then that they met the borrower, 38-year-old Aquil Cunningham-Camacho.

According to their report, the enraged borrower “began to scream and yell at officers about the vehicle being repossessed,” which prompted officers to ask him “to step back three times,” and after that, things took a turn for the worse.

“On his fourth attempt to approach me I placed my hand on his chest and told him to step back. Cunningham-Camacho did have a clenched fist.”  According to Babik’s affidavit, this is when he took a swing at the officers.

The officers reported that “Constable Fitting at my request tactfully placed Cunningham-Camacho on the ground,” where he allegedly “continued to fight and resist arrest by attempting to punch and wrestle with Constable Fitting,”

Eventually, Cunningham-Camacho was subdued, cuffed, and placed in the patrol vehicle. According to the affidavit.

Cunningham-Camacho’s punches likely connected with the officers. He has been charged with two felony counts of aggravated assault and two misdemeanor counts of simple assault and disorderly conduct. He is being held at Adams County Prison after being unable to post the $10,000 cash bail, according to a magisterial docket.
