Odessa, TX – March 17, 2022 – Recovery Agent Miguel Angel Mota’s night was going well. He was in the process of recovering a vehicle and ready to tow it away when things took a turn for the worse. The borrower had arrived with a gun.
According to police, the alleged assault occurred in the 100 block of E. 52nd Street on March 15th . It was at 2:22 am when they received the call.
According to the repossessor, Mota, he had the vehicle lifted on his tow truck and was in the process of repossessing it, when borrower, 59-year-old Michael John Malone, ran up to him ordering him to put it down.
Mota reported to officers that he refused to comply with Malone’s orders and that’s when Malone drew his black Smith and Wesson M&P .45 handgun. Malone then reportedly struck Mota’s truck with it before turning the gun on Mota causing him to fear for his life.
Police made contact with Malone and took him into custody reading him his Miranda Warning. In interviewing Malone, he admitted to drawing his gun and striking Mota’s truck, but claimed that he had kept the barrel of the gun pointed directly to the ground.
Malone allegedly admitted there was no immediate need for him to draw his firearm at any point in time.
Malone was arrested and booked into the Ector County Law Enforcement Center with a bond of $25,000. Malone was still in custody as of Thursday afternoon.
