Settlement agreement releases Relentless Recovery from its Licensing Agreement with DRN, including its Non-Competition Provision

CLEVELAND, OH (October 26, 2022) – Relentless Recovery, Inc., the largest collateral recovery and remarketing company servicing the state of Ohio, today announced it has entered into a settlement agreement with Digital Recognition Network, Inc. (DRN), now a subsidiary of Motorola Solutions, to terminate its license agreement. The landmark settlement eliminates the non-competition agreement, allowing Relentless Recovery to freely work with other license plate recognition (LPR) technology providers and develop related technology to optimize operations.

Relentless Recovery has always been a leader in the use of detection technology such as LPR technology and in 2009 was one of the first to work with DRN.  Since then, the LPR technology space has grown with other companies providing the same services. In October 2022, Relentless Recovery provided written notice to DRN that it was terminating the License Agreement and began doing business with Insight LPR, a competitor that does not share LPR data with other recovery agents.

On December 30, 2022, DRN filed a lawsuit against Relentless Recovery in the U.S. District Court for the Northern District of Texas, Fort Worth Division, asserting a cause of action for breach of contract based upon violation of the Non-Competition Provision.

Both Relentless Recovery and DRN desired to resolve the lawsuit and reached a settlement agreement resulting in Relentless Recovery paying DRN a sum equivalent to the revenue share generated over a year plus attorney fees over 30 consecutive months. The settlement took a year of negotiations between Relentless Recovery and DRN. Working with attorney Marshall Searcy, and Bob Shapiro from Chapman Spingola, LLP, the companies agreed to settle outside of the courtroom.

“Litigation is not how we want to spend our time or our resources,” said Amy Bednar, co-founder of Relentless Recovery. “Considering the investment, we make in LPR annually, it was a simple choice and we’re pleased with the outcome. We have paved the path for other recovery agents to exercise their freedom of choice. We hope DRN will develop a transparent framework to facilitate future termination proceedings.”

As a result of the settlement and Relentless Recovery’s ability to work with another LPR provider, Relentless Recovery has developed tools to optimize its collection efforts and is now able to collect as much data as possible without the concern of its competitors using it.  Relentless Recovery now maintains the largest closed source of LPR data, collecting more than five million monthly scans only accessible by assigning to Relentless Recovery.
