Houston, TX – 2 May 2019 – A tow truck driver is being charged with failing to stop and render aid after witnesses said he left a 68-year-old man lying injured in the street after the man tried to stop him from repossessing his SUV.
The accident happened at about 7:30 a.m.
Thursday in the 7400 block of South Gessner at Triola.
Witnesses said a neighbor knocked on the door and alerted Alberto Nduli that
his SUV was being towed from his apartment.
Nduli, who worked as a security guard and was a father and grandfather, ran outside to confront the tow truck driver.
Police said Nduli tried to stop him, and jumped on the hood of the SUV as it was being towed. Nduli fell off the hood of the vehicle and hit his head on the pavement, and died at the scene, police said.
The tow truck driver drove away with the SUV, and dropped it off at a storage facility and was called back to the scene by police, officials said.
The tow truck driver sped off, dropping the repossessed SUV off at the tow truck’s lot,
Houston Police Department Capt. Deese said. Hours later, the driver returned to the scene and was immediately placed in handcuffs.
He will likely face a felony charge of failure to stop and render aid, which carries a 20-year sentence, if he is convicted. His identity was not immediately released.
“He left the scene,” Sean Teare, who heads up the Harris County DA’s vehicular crimes division said. “By his own admissions prior to returning to the scene, he knew there was an altercation. He knew the owner of the vehicle was there and involved in a crash. Whether or not he knew that individual lost his life really is immaterial as to whether or not there’s a failure to stop and render aid charge.”
The charge addresses whether someone ‘knew’ or ‘should have known’ someone was injured. “In this case, someone was more than injured. Tragically, someone lost their life over something that shouldn’t have happened,” said Teare.
Teare said the tow truck driver, who has not been identified, is facing charges for failing to stop and render aid in the very least, but that additional charges could be considered.
