Odessa, TX – 18 April 2019 – Odessa Police arrested a 44-year-old man late Wednesday night after he allegedly threatened a repo man with a knife during an attempt to get his Chevrolet Tahoe off the tow lift during a repossession.
Michael Anthony Baker was charged with aggravated assault with a deadly weapon, a second-degree felony, and hindering a secured creditor of more than $2,500 and less than $30,000, a state jail felony.
The assault happened Wednesday near the intersection of Crockett Street and McKnight Drive, the affidavit stated.
Officers saw a Chevrolet Tahoe with the back tires lifted off the ground by a tow truck, the affidavit detailed. Baker was reportedly standing outside the vehicle and he entered the driver’s seat when officers approached him.
The tow truck driver was identified as 55-year-old Melvin Toliver, the affidavit stated. Toliver told officers that Baker threatened him with a knife and Baker had the knife on him.
Officers ordered Baker to exit the vehicle and when he did officers saw a black knife in a sheath on his right hip, the affidavit detailed. Officers did a sweep of the vehicle and saw the keys were in the ignition.
Toliver stated he was there to repo the vehicle and he showed officers the repossession order for the Tahoe, the affidavit detailed. Toliver stated after he hooked onto the back of the vehicle, Baker approached him yelling. Toliver stated Baker drew a knife from his right side and threatened him.
Toliver reported Baker attempted to drive forward off of the tow truck but he was unsuccessful. Toliver stated the vehicle was valued more than $7,000 but less than $30,000.
Officers read Baker his Miranda Warning and he waived his rights, the affidavit stated. Baker told officers he attempted to drive the vehicle off the tow truck, but he didn’t take his knife out of the sheath at any time.
Baker was arrested, charged and transported to the Ector County Law Enforcement Center. He has two bonds totaling $65,000 and was still in custody as of Thursday afternoon, jail records show.
