Allstar Recovery and two employees are named as defendants in the lawsuit

 

Decatur, AL – November 15, 2024 – They didn’t pull the trigger, but they did request the police standby that led to the death of borrower Stephen Perkins. Now, the Repossessors and the agency they work for are facing a wrongful death lawsuit. While successfully moving the lawsuit to arbitration, the arbitrator is not necessarily one with a history of good relations with the repossession industry, it is the Alabama Better Business Bureau.

Named in the lawsuit are the Lender, Pentagon Federal Credit Union (PenFed), America’s second-largest federal credit union, serving over 2.9 million members worldwide with $35.4 billion in assets as of November 1, 2023, according to their website.

Allstar Recovery and the repossessors involved in the incident were named as Caleb Combs and Richie Brady.

The Shooting

As previously reported, 39-year-old father and borrower Stephen Perkins, was gunned down by officers from the Decatur Police Department outside his home on September 29 in Decatur, Alabama. Police claimed that a repossessor, later identified as employed by All Star Recovery, had previously attempted to repossess Perkins truck when it is alleged that Perkins pulled a gun on him. This resulted in the agent calling 911.

Wrongful Death During Repossession Lawsuit Moves to ArbitrationWhile police have yet to release police bodycam footage of the incident, video surveillance cameras captured from neighbors captured the moment Perkins was gunned down. A total of eighteen rounds were fired at him.

Video was also captured showing an agent from Allstar Recovery towing away Perkins truck as he laid dying just feet away. He begins leaving the scene after about 30 seconds into the video while officers can be seen still patting the dying Perkins on the ground behind him. Perkins’ final words were said to be ‘help.’

The video footage had triggered renewed outrage in Decatur at both the police department for allowing the repossession to commence and at All Star recovery whom local activist claim was a needless death. 

In the video, at Decatur officers can be seen standing over the body of Perkins in his front lawn after gunning him down. At the same time, the repossession agent can be seen towing away Perkins’ white GMC Sierra.

The Decatur Police only made things worse when they admitted to reporting a crucial piece of their original allegations that Perkins had been told to drop a gun that he’d been holding but had refused to follow the orders to do so.

Decator Police Chief, Todd Pinion later said Perkins had been ordered to ‘get on the ground’ by officers who’d identified themselves as police. Video evidence showed that officers opened fire before the final order was given when Perkins pointed his flashlight reportedly attached to his pistol. The omission of this critical detail created a firestorm of outrage and suspicion by neighbors and the community.

The lawsuit against Officer Bailey Marquette has been allowed to go forward, but a federal judge has dismissed several claims in the lawsuit, including those filed against three former Decatur police officers – Christopher Mukkadam, Joey Williams and Vance Summers and the City of Decatur.

The repossession company, Allstar Recovery and the two employees have argued they want the claims against them handled by an arbitrator, saying the Perkins family’s claims fall under the arbitration clause laid out in the purchase agreement for Stephen Perkins’ truck.

In a September court filing, Perkins family lawyers argued that the wrongful death claims in the case fall outside the scope of the arbitration agreement because they are not contract-related. They also argued that since the company chose the arbitration forum, they should not be required to arbitrate claims to an ‘unidentified and unknown’ arbitrator.

But the order granting a motion to compel arbitration on Thursday by U.S. District Judge Corey Maze said the question of whether arbitration is the right forum, the “arbitrability,” would be up to the Better Business Bureau of North Alabama to decide.

“Allstar contacted the contractually agreed upon arbitrator—the Better Business Bureau of North Alabama—about this case. But the Better Business Bureau of North Alabama declined to serve as arbitrator … All that BBB must do is arbitrate the scope of the arbitration agreement. If the BBB finds that the claims Perkins brings don’t fit within the scope of the arbitration agreement, then the BBB can simply send Perkins’s claims back to this court,” the filing says.

Documents state the BBB’s arbitration process is intended to “resolve disputes between a buyer and a seller, and a wrongful death claim exceeds the capabilities,” of that process. The BBB previously declined to arbitrate the matter, citing this process. The court also denied Allstar Recovery’s motion to dismiss the claims against them.

Despite the claims against three of the former officers and the City of Decatur being dropped, the claims against Marquette were allowed to move forward because the court found the Perkins’ family lawyers — at this stage — made a successful argument that Marquette’s use of deadly force was not justified.

“Assuming these facts are true, Officer Marquette would not be entitled to qualified immunity because, when Marquette used deadly force, Perkins was neither trying to leave the scene nor posing a serious threat of physical harm to others,” The court said. “Nor did Marquette warn Perkins that he might use deadly force before he shot him.”The judge also said that the dismissals, including of some claims against Marquette, were done “without prejudice” and he will allow the Perkins’ family lawyers to reargue the claims one more time.

Marquette’s criminal trial in the case is set for April.

“He’s shooting at me! He’s shooting at me!” – 911 Call

 

West Palm Beach, FL – October 31, 2024 – Sometimes bad things happen in nice places as we reported a couple of weeks ago with the story of a husband and wife who chased and allegedly opened fire on a repossessor as he was towing away their Maserati. As it turns out, the agent was wearing a body cam and we have part of the video.

Court records report that just after 1am on Wednesday the 30th of October, a still unnamed repossession agent arrived at the quiet gated community home of Brian and Lori Martin of Wellington to recover a Maserati. Having successfully lifting it, the agent reported that the borrower, Brian Martin is reported to have rushed out of the home shirtless and with a black pistol in hand.

Wisely, the agent fled. But as he stopped at the community gates to secure the vehicle, Brian Martin came back and opened fire on the agent as his wife Lori was at the wheel of their Mercedes SUV.

The report states that the Martins proceeded to chase the Repossessor along Lake Worth Road, while Brian allegedly fired additional shots from the passenger seat as the agent called 911.

In the frantic body camera video, you can hear the repossessor on his call with 911 operators reporting the incident.

Responding police stopped the Mercedes and arrested both of the Martins. Inside the Mercedes, deputies found a semi-automatic handgun and a bullet. When interviewed, the couple were reported to have admitted their intention to reclaim the Maserati from the agent and Brian also admitted to having fired the weapon to intimidate the driver.

WATCH Video of Repossession Agent Under Fire“I am shaken up, but I’m OK,” the repossessor later told deputies after they responded at the scene.

Brian Martin faces charges of attempted second-degree murder and aggravated assault with a weapon. Lori Martin also faces an attempted second-degree murder charge. Both are scheduled to appear in court again in December.

In a court filing this week, Brian Martin’s public defender asked for his bond to be reduced to $55,000.

“This is an isolated incident where Mr. Martin’s vehicle was being towed under unclear circumstances in the dead of night. He was awoken in the early morning hours to his car alarm going off. It was a chaotic situation, and unlikely to ever be replicated again,” the filing said.

Houston, TX – November 5, 2024 – On October 9th at about 2:30pm, 40-year-old Repossessor, Benjamin Bolton, was chased and gunned down by several men following a repossession. And while the agent fought for his life from the eight rounds pumped into him, Police merely detained the alleged shooters. Well, here we are three weeks later and the District Attorney has finally charged a 19-year-old man with the shooting.

19-Year-Old Wanted for Shooting Repo ManThe original incident occurred back on October 9th at about 2:30pm, when 40-year-old Repossessor and father of two, Benjamin Bolton and a coworker spotted a white van assigned for repossession at the 900 block of Broadway in Houston. Already having one repossessed vehicle on the tow truck and having keys to the van, Benjamin hopped behind the wheel.

Having successfully cleared the area, all seemed safe until two miles later at the 7900 block of Harrisburn Blvd. It was there that reportedly two vehicles arrived. One blocked him off from the front and one pulled up alongside him.

It was then that allegedly three men opened fire on him firing a reported thirteen rounds into the van. Eight rounds struck Benjamin. Three struck him in the arm, three in the abdomen, one in the pelvic area, and one became lodged between his heart and his lung.

Bolton was rushed to Ben Taub Hospital where doctors began the first of what will be many surgeries.

According to his interviewed mother; “They had to actually leave his stomach open because they didn’t know what kind of damage, because there was so much blood and trauma. They didn’t want to close him up, and come back and open him up again to make sure they didn’t miss something,”

She added,” Tow truck drivers get a bad rep, but they just do their job. That’s a job to them, to pay the bills and feed their families and there is nothing in this world worth killing somebody over.”

After almost three weeks, on October 30th, the Police have named and charged Brandon Munoz, 19, with aggravated assault with a deadly weapon as the investigation continues.

But unlike that cheesy show, the agent chose to flee with the Maserati on the lift rather than wrestle in the yard. Unfortunately, he probably should have picked a better location to secure it and soon found himself chased and under fire.

Chester Township, OH – October 23, 2024 – The repossession went smoothly. Pulling into the parking lot of a church to strap it down properly, things took a turn for the worse.

On Tuesday the 22nd, officers of the Chester Township Police Department responded to an assault call by a repossession agent at the parking lot of the Mayfield United Methodist Church along Mayfield Road.

Upon arrival, officers took testimony from an unnamed repossessor who claimed that he had successfully repossessed a vehicle from a nearby residence and had pulled into the church parking lot to secure the unit when a vehicle sped into the lot and blocked his exit.

 

A dashboard-mounted camera in the tow truck shows a vehicle approach him from the front, blocking him in.

Even before that vehicle comes to a complete stop, the passenger exits with a handgun, pointing it at the tow truck driver as he angrily approaches.

“The dude kept flashing the gun, pointed it at me, cocking it and then he shot towards the back of my truck. … He kept threatening he’s going to put a bullet in my head, he’s getting three more dudes to follow me to make sure I’m not calling the police,” the agent told a police dispatcher in a call made after the incident.

“During the course of the event, the individual is being ordered from the tow truck to release the vehicle. The gun, of course, is being pointed at him, as you know, and at some point, the gun was discharged in his direction,” said Chester Township Police Chief Craig Young.

“I couldn’t get it unstrapped fast enough and, you know, then he fired the gun off and then kept threatening me. He pointed it at me several times,” the driver told police.

“This occurred in a church parking lot where there is a preschool in session, so now we enter into a situation where technically you are in a school safety zone and you are discharging a firearm — and really that’s the reason this investigation is ongoing,” said Young.

In addition to being roughed up and threatened, the tow truck driver told police his assailants took his cell phone and threw it into a pond.

One of them  got into the vehicle that was being repossessed and the other into the vehicle they arrived in and both drove off.Repo Ends in Gunfire and Armed Robbery

The tow truck driver made his 911 call from a phone at a nearby gas station, giving police the address from where the vehicle was being repossessed and the name of the vehicle owner on the account, Ronald Delisio.

Officers quickly identified the second suspect as Kevin Delisio. Both were arrested without incident.

The men now face charges of aggravated robbery, kidnapping and aggravated menacing and will likely face additional charges as the investigation continues.

Isabella County, MI – October 23, 2024 – It was in broad daylight on a rural country road when the Repossessor showed up to repossess a vehicle. With no one emerging from the residence, he failed to notice the armed man on a tractor coming up on him.

According to the Isabella County Sheriff’s Office, an unnamed repo man in a tow truck went to a rural country residence on the 5000 block of South Lincoln Road in Union Township at around 11:30 am to repossess a vehicle.

That’s when police say a 29-year-old suspect pulled out a handgun and began firing shots at the Repossessor from a tractor he was operating on the roadway.

Fortunately, the agent was not hit and did not report any injuries.

As fate would have it, a detective and deputy were just across the road on an unrelated call and were quick to apprehend the suspect inside his home. They quickly located the firearm and several spent shell casings found at the scene.

While the agent emerged from the incident reportedly unscathed, Investigators took the suspect to an area hospital for treatment of a minor injury sustained when he allegedly pounded his head against a plastic divider inside a police patrol car.

The suspect was then transported to the Isabella County Jail where he awaits arraignment on charges of assault with intent to murder and assault with a dangerous weapon. The suspect’s name was not released Wednesday because he had not yet been arraigned.

Denver, CO – October 18, 2024 – Always check the backseat! After checking the VIN, it is probably the most basic steps to perform before leaving with a repo. But apparently, a deep sleeping kid and a lack of following the basics led to yet another story of a car being repossessed with a sleeping child inside.

Police received a call about a stolen car and a kidnapping at about at about 9:23 am from a family who were reportedly “just passing through” and had stopped by the hotel in the 11900 block of West 6th Avenue to do laundry. During this time, they left a 13-year-old sleeping in the back of the car.

“Oh my. What do you think? I think someone had stolen my kid,” the child’s uncle Alex Vasile said.

Lakewood police said they tracked down the car within 20 minutes because of a tracking system inside. Locating the car at the lot of an unnamed tow yard on the 800 block of East 48th Avenue, police made contact with the person responsible for the repossession who still claimed to be unaware the boy was in the car.

Officers said that they had to bang on the windows of the locked car vigorously to wake the boy up. Officers reported that the boy slept through the whole incident.

“I sleeping in the car. I sleep 10 minutes, and I don’t know! I’m sleeping you know!” said Mario Mustata, the boy who slept in the car.

Police confirmed the child is now safe and reunited with his family.

The obvious presence of GPS in the vehicle that police used to locate the vehicle lends to the probability that the car was owned by a Buy-Here-Pay-Here lot.

Thirteen is really on the edge of childhood and adolescence, but anyone who can sleep through being towed away in a car seems to have a similar lack of awareness.

Houston, TX – October 14, 2024 – They already had a car on the tow truck, so 40-year-old father of two Benjamin Bolton chose to drive the repossessed van away. The Houston Police Department told Fox 26 news that the investigation is ongoing, but three men were detained, and they are waiting on possible charges from the DA’s office.

According to reliable sources, an agent of a fulltime established repossession agency has spoken to the victim in the hospital. Benjamin was employed by a “Buy-Here-Pay-Here” lot and not an employee of a bona fide repossession company at the time of the shooting.

Benji will be undergoing a lot of surgeries in the next week and will be out of work for several months. His family and friends have been by his side since the moment the shots were fired.  New details have emerged on the tragic murder of Khyré Grier on a rainy night on September 26th that shed some additional details of what happened that night according to reporters from Charolette based WSOC TV. Rather than diluting their interviews, I will share them verbatim.

The victim’s family told Channel 9′s Hunter Sáenz that Khyre Grier was just doing his job when he was killed. Grier, 25, was a father to a 5-year-old and a newborn.

“He was smart. He loved cars,” said his mother, Tamara Grier.

“And the job he has, well, he had — excuse me. He loved it. He loved his towing job.”

The grieving mother spoke with Sáenz over the phone.

“I really don’t know how I’m going to cope with this,” she said. “I don’t know how I’m going to get through it.”

The Charlotte-Mecklenburg Police Department’s team who tracks down the most violent criminals in the city were trying to find Ramon Alexi Santos Funes, 34, who they believe helped kill him.

CMPD homicide Sgt. Eduardo Quevedo said on Sept. 26, Grier was found shot to death in the driver’s seat of his tow truck at an apartment complex off Eastcrest Drive in east Charlotte.

Grier’s mother told Sáenz his girlfriend was on the phone with him right before he was killed and could hear people talking to him in Spanish.

“The last thing she heard was him saying that he was going to drop the car. So, he already had the car up there,” his mom said.

Court records said the killing was captured on a dashboard camera inside the tow truck.

“It just seems he was a young man doing his job and he didn’t deserve this,” Sgt. Quevedo said.

CMPD said that same day, they arrested Fabio Herminio Funes, 49. He was charged with first-degree murder at the end of an interview with detectives.

The next day, detectives asked for help finding his brother, who they later identified as Ramon Funes.

“We believe there are people out there who know more than what they’re saying,” Sgt. Quevedo said hours before the announcement that Ramon Funes was arrested.

That was why Quevedo asked people to come forward if they knew where Ramon Funes was so it could lead to closure for Grier’s family.

“Just do the right thing,” Grier’s mom said. “What’s wrong is wrong and what’s right is right.”

Sáenz learned Ramon Funes was from Honduras. He asked police if they were worried he may have gone back to that country, and they said while it’s a possibility, they want him in jail.

25-Year-Old Father Left Dead in the Rain for five hours

 

Charlotte, NC – September 30, 2024 – In a heavy rain, at 7:00 am on the morning of September 26th, officers of the Charlotte-Mecklenburg Police Department responded to a welfare check on Eastcrest Drive, Charlotte, NC. Upon arrival, they discovered the body of 25-year-old Repossessor Khyré Jamaal Grier. The cause of death was of gunshot wounds that had occurred over five hours earlier.

The repossession attempt at a townhouse complex at 1720 Eastcrest Drive is reported to have occurred at approximately 2 am when the alleged borrower 49-year-old Fabio Herminio Funes saw him attempting to repossess his vehicle. An argument reportedly ensued and Funes is reported to have opened fire.

It is unclear if Grier died immediately or in the five hours that followed until police arrived for the welfare check at 7 am.

According to the local press, Grier worked for Carolina Towing Company LLC.

Funes was captured the same day and police are also looking out for an unnamed accomplice whose photo they have released. It is reported that the tow truck was equipped with cameras that would have captured the incident.

Funes has been charged with murder.

According to local press, on Instagram it is reported that Khyre was the recent father of a baby son.

Police are still looking for this unnamed suspected accomplice

Debtor wasn’t even out for repossession

Hialeah, FL – September 25, 2024 – When a borrower gets behind on car payments, they can get a little paranoid. So paranoid, that when they see a Repo Man they can make assumptions that lead them to ram their truck into the tow truck, pull a gun on him and then chase him for miles while firing on him. Of course, none of this was necessary, he wasn’t even out for repo.

The unnamed Repossessor was only driving through the neighborhood checking plates in the area of West 21th Court and 56th Street. Little did he know that Daniel Betancur, of Hialeah had seen him. Enraged by paranoia or vengeance from a different encounter, Betancur proceeded to ram his truck into the tow truck.

Producing a gun, he allegedly aimed it at the repossession agent. Wisely, the agent fled, but Betancur wasn’t done with him yet and he took chase.

For a reported miles long chase, Betancur allegedly fired numerous shots at the agent until an officer in Medley intervened and took the man into custody.

Betancur is facing multiple charges including 2nd degree attempted murder and aggravated stalking.

According to police, Betancur’s truck wasn’t even out for repo. The unnamed Repossessor was not struck by any bullets, nor was his truck according to police.

“You’re going to die today,”

Oakland, CA – September 20, 2024 – One unfortunate repossession agent found out the hard way that some people have a pretty special love for their Cadillac. Taking gunfire, he also learned to be careful with what you leave within reach of the borrower in the bed of his tow truck.

Back on August 31st, an unnamed Repossessor had already lifted a Cadillac with his tow truck lift when he met it’s RO. The also unnamed, 51-year-old borrower residing on the 7800 block of Crest Avenue had allegedly exited the residence and opened fire with two rounds.

Angry and ranting “You’re not taking my car,” the man allegedly grabbing the victim’s jack handle in the bed of his tow truck and began punching him repeatedly. The agent suffered a head injury and later told police his attacker told him, “You’re going to die today,” during the assault, authorities said.

The suspect borrower told police that he believed the repo man was actually a person who had been breaking into vehicles in the neighborhood and claimed that he actually helped the Repo Mand when he found out what was actually doing.

Police reported that when they arrived they found the victim Repossessor was outside in a pool of his own blood and the suspect was inside his nearby home. The suspect later admitted he knew he had incurred an outstanding debt of $2,000, authorities said.

The borrower has been released on $60,000 bail, with court-ordered conditions that include an understanding that police can search his home for weapons at any time, and that he stay away from the victim. His next court date has been set for October.
