Allstar Recovery and two employees are named as defendants in the lawsuit

 

Decatur, AL – November 15, 2024 – They didn’t pull the trigger, but they did request the police standby that led to the death of borrower Stephen Perkins. Now, the Repossessors and the agency they work for are facing a wrongful death lawsuit. While successfully moving the lawsuit to arbitration, the arbitrator is not necessarily one with a history of good relations with the repossession industry, it is the Alabama Better Business Bureau.

Named in the lawsuit are the Lender, Pentagon Federal Credit Union (PenFed), America’s second-largest federal credit union, serving over 2.9 million members worldwide with $35.4 billion in assets as of November 1, 2023, according to their website.

Allstar Recovery and the repossessors involved in the incident were named as Caleb Combs and Richie Brady.

The Shooting

As previously reported, 39-year-old father and borrower Stephen Perkins, was gunned down by officers from the Decatur Police Department outside his home on September 29 in Decatur, Alabama. Police claimed that a repossessor, later identified as employed by All Star Recovery, had previously attempted to repossess Perkins truck when it is alleged that Perkins pulled a gun on him. This resulted in the agent calling 911.

Wrongful Death During Repossession Lawsuit Moves to ArbitrationWhile police have yet to release police bodycam footage of the incident, video surveillance cameras captured from neighbors captured the moment Perkins was gunned down. A total of eighteen rounds were fired at him.

Video was also captured showing an agent from Allstar Recovery towing away Perkins truck as he laid dying just feet away. He begins leaving the scene after about 30 seconds into the video while officers can be seen still patting the dying Perkins on the ground behind him. Perkins’ final words were said to be ‘help.’

The video footage had triggered renewed outrage in Decatur at both the police department for allowing the repossession to commence and at All Star recovery whom local activist claim was a needless death. 

In the video, at Decatur officers can be seen standing over the body of Perkins in his front lawn after gunning him down. At the same time, the repossession agent can be seen towing away Perkins’ white GMC Sierra.

The Decatur Police only made things worse when they admitted to reporting a crucial piece of their original allegations that Perkins had been told to drop a gun that he’d been holding but had refused to follow the orders to do so.

Decator Police Chief, Todd Pinion later said Perkins had been ordered to ‘get on the ground’ by officers who’d identified themselves as police. Video evidence showed that officers opened fire before the final order was given when Perkins pointed his flashlight reportedly attached to his pistol. The omission of this critical detail created a firestorm of outrage and suspicion by neighbors and the community.

The lawsuit against Officer Bailey Marquette has been allowed to go forward, but a federal judge has dismissed several claims in the lawsuit, including those filed against three former Decatur police officers – Christopher Mukkadam, Joey Williams and Vance Summers and the City of Decatur.

The repossession company, Allstar Recovery and the two employees have argued they want the claims against them handled by an arbitrator, saying the Perkins family’s claims fall under the arbitration clause laid out in the purchase agreement for Stephen Perkins’ truck.

In a September court filing, Perkins family lawyers argued that the wrongful death claims in the case fall outside the scope of the arbitration agreement because they are not contract-related. They also argued that since the company chose the arbitration forum, they should not be required to arbitrate claims to an ‘unidentified and unknown’ arbitrator.

But the order granting a motion to compel arbitration on Thursday by U.S. District Judge Corey Maze said the question of whether arbitration is the right forum, the “arbitrability,” would be up to the Better Business Bureau of North Alabama to decide.

“Allstar contacted the contractually agreed upon arbitrator—the Better Business Bureau of North Alabama—about this case. But the Better Business Bureau of North Alabama declined to serve as arbitrator … All that BBB must do is arbitrate the scope of the arbitration agreement. If the BBB finds that the claims Perkins brings don’t fit within the scope of the arbitration agreement, then the BBB can simply send Perkins’s claims back to this court,” the filing says.

Documents state the BBB’s arbitration process is intended to “resolve disputes between a buyer and a seller, and a wrongful death claim exceeds the capabilities,” of that process. The BBB previously declined to arbitrate the matter, citing this process. The court also denied Allstar Recovery’s motion to dismiss the claims against them.

Despite the claims against three of the former officers and the City of Decatur being dropped, the claims against Marquette were allowed to move forward because the court found the Perkins’ family lawyers — at this stage — made a successful argument that Marquette’s use of deadly force was not justified.

“Assuming these facts are true, Officer Marquette would not be entitled to qualified immunity because, when Marquette used deadly force, Perkins was neither trying to leave the scene nor posing a serious threat of physical harm to others,” The court said. “Nor did Marquette warn Perkins that he might use deadly force before he shot him.”The judge also said that the dismissals, including of some claims against Marquette, were done “without prejudice” and he will allow the Perkins’ family lawyers to reargue the claims one more time.

Marquette’s criminal trial in the case is set for April.

“He’s shooting at me! He’s shooting at me!” – 911 Call

 

West Palm Beach, FL – October 31, 2024 – Sometimes bad things happen in nice places as we reported a couple of weeks ago with the story of a husband and wife who chased and allegedly opened fire on a repossessor as he was towing away their Maserati. As it turns out, the agent was wearing a body cam and we have part of the video.

Court records report that just after 1am on Wednesday the 30th of October, a still unnamed repossession agent arrived at the quiet gated community home of Brian and Lori Martin of Wellington to recover a Maserati. Having successfully lifting it, the agent reported that the borrower, Brian Martin is reported to have rushed out of the home shirtless and with a black pistol in hand.

Wisely, the agent fled. But as he stopped at the community gates to secure the vehicle, Brian Martin came back and opened fire on the agent as his wife Lori was at the wheel of their Mercedes SUV.

The report states that the Martins proceeded to chase the Repossessor along Lake Worth Road, while Brian allegedly fired additional shots from the passenger seat as the agent called 911.

In the frantic body camera video, you can hear the repossessor on his call with 911 operators reporting the incident.

Responding police stopped the Mercedes and arrested both of the Martins. Inside the Mercedes, deputies found a semi-automatic handgun and a bullet. When interviewed, the couple were reported to have admitted their intention to reclaim the Maserati from the agent and Brian also admitted to having fired the weapon to intimidate the driver.

WATCH Video of Repossession Agent Under Fire“I am shaken up, but I’m OK,” the repossessor later told deputies after they responded at the scene.

Brian Martin faces charges of attempted second-degree murder and aggravated assault with a weapon. Lori Martin also faces an attempted second-degree murder charge. Both are scheduled to appear in court again in December.

In a court filing this week, Brian Martin’s public defender asked for his bond to be reduced to $55,000.

“This is an isolated incident where Mr. Martin’s vehicle was being towed under unclear circumstances in the dead of night. He was awoken in the early morning hours to his car alarm going off. It was a chaotic situation, and unlikely to ever be replicated again,” the filing said.

Houston, TX – November 5, 2024 – On October 9th at about 2:30pm, 40-year-old Repossessor, Benjamin Bolton, was chased and gunned down by several men following a repossession. And while the agent fought for his life from the eight rounds pumped into him, Police merely detained the alleged shooters. Well, here we are three weeks later and the District Attorney has finally charged a 19-year-old man with the shooting.

19-Year-Old Wanted for Shooting Repo ManThe original incident occurred back on October 9th at about 2:30pm, when 40-year-old Repossessor and father of two, Benjamin Bolton and a coworker spotted a white van assigned for repossession at the 900 block of Broadway in Houston. Already having one repossessed vehicle on the tow truck and having keys to the van, Benjamin hopped behind the wheel.

Having successfully cleared the area, all seemed safe until two miles later at the 7900 block of Harrisburn Blvd. It was there that reportedly two vehicles arrived. One blocked him off from the front and one pulled up alongside him.

It was then that allegedly three men opened fire on him firing a reported thirteen rounds into the van. Eight rounds struck Benjamin. Three struck him in the arm, three in the abdomen, one in the pelvic area, and one became lodged between his heart and his lung.

Bolton was rushed to Ben Taub Hospital where doctors began the first of what will be many surgeries.

According to his interviewed mother; “They had to actually leave his stomach open because they didn’t know what kind of damage, because there was so much blood and trauma. They didn’t want to close him up, and come back and open him up again to make sure they didn’t miss something,”

She added,” Tow truck drivers get a bad rep, but they just do their job. That’s a job to them, to pay the bills and feed their families and there is nothing in this world worth killing somebody over.”

After almost three weeks, on October 30th, the Police have named and charged Brandon Munoz, 19, with aggravated assault with a deadly weapon as the investigation continues.

Isabella County, MI – October 23, 2024 – It was in broad daylight on a rural country road when the Repossessor showed up to repossess a vehicle. With no one emerging from the residence, he failed to notice the armed man on a tractor coming up on him.

According to the Isabella County Sheriff’s Office, an unnamed repo man in a tow truck went to a rural country residence on the 5000 block of South Lincoln Road in Union Township at around 11:30 am to repossess a vehicle.

That’s when police say a 29-year-old suspect pulled out a handgun and began firing shots at the Repossessor from a tractor he was operating on the roadway.

Fortunately, the agent was not hit and did not report any injuries.

As fate would have it, a detective and deputy were just across the road on an unrelated call and were quick to apprehend the suspect inside his home. They quickly located the firearm and several spent shell casings found at the scene.

While the agent emerged from the incident reportedly unscathed, Investigators took the suspect to an area hospital for treatment of a minor injury sustained when he allegedly pounded his head against a plastic divider inside a police patrol car.

The suspect was then transported to the Isabella County Jail where he awaits arraignment on charges of assault with intent to murder and assault with a dangerous weapon. The suspect’s name was not released Wednesday because he had not yet been arraigned.

Houston, TX – October 14, 2024 – They already had a car on the tow truck, so 40-year-old father of two Benjamin Bolton chose to drive the repossessed van away. He hadn’t gone two miles when a car blocked him off and another pulled up alongside him and opened fire. Benjamin was struck eight times and is currently fighting for his life in the ICU.

The Houston Police Department told Fox 26 news that the investigation is ongoing, but three men were detained, and they are waiting on possible charges from the DA’s office.

According to reliable sources, an agent of a fulltime established repossession agency has spoken to the victim in the hospital. Benjamin was employed by a “Buy-Here-Pay-Here” lot and not an employee of a bona fide repossession company at the time of the shooting.

Benji will be undergoing a lot of surgeries in the next week and will be out of work for several months. His family and friends have been by his side since the moment the shots were fired. He is surrounded by people that love him. He is being cared for by amazing doctors at Ben Taub in Houston, Texas, reports his family on his GoFundMe page.

Debtor wasn’t even out for repossession

Hialeah, FL – September 25, 2024 – When a borrower gets behind on car payments, they can get a little paranoid. So paranoid, that when they see a Repo Man they can make assumptions that lead them to ram their truck into the tow truck, pull a gun on him and then chase him for miles while firing on him. Of course, none of this was necessary, he wasn’t even out for repo.

The unnamed Repossessor was only driving through the neighborhood checking plates in the area of West 21th Court and 56th Street. Little did he know that Daniel Betancur, of Hialeah had seen him. Enraged by paranoia or vengeance from a different encounter, Betancur proceeded to ram his truck into the tow truck.

Producing a gun, he allegedly aimed it at the repossession agent. Wisely, the agent fled, but Betancur wasn’t done with him yet and he took chase.

For a reported miles long chase, Betancur allegedly fired numerous shots at the agent until an officer in Medley intervened and took the man into custody.

Betancur is facing multiple charges including 2nd degree attempted murder and aggravated stalking.

According to police, Betancur’s truck wasn’t even out for repo. The unnamed Repossessor was not struck by any bullets, nor was his truck according to police.

Columbia, SC – September 13, 2024 – She’d been hiding her car for days when 46-year-old Repossessor Steven Hughes caught up to her. Waking her brother for help, Hughes was murdered. After hiding the car after the shooting and trying to hide the gun, the judge set her bond at a mere $75,000.

On Wednesday the 11th, a bond hearing was held for 19-year-old Essence Jackson and her brother, 20-year-old Raheem Jackson, who prosecutor claim was responsible for shooting and killing Repossessor Steven Hughes on Fairmont Drive back on June 10th.

Prosecutors told the Judge that Hughes had come to the area to repossess a car belonging to Essence and text messages on her phone revealed that she was responsible for moving the car from the incident and attempting to hide the gun her brother allegedly used to kill Hughes.

“I was hoping for a little more because, I mean, she was still an accessory. She still played a part in it, but hopefully, maybe she’ll learn from it,” said Stephanie Hughes, the victim’s daughter. “He was caring, he was compassionate. Even in his job he was. He didn’t deserve to go like this, but he’s gonna be remembered the way he should.”

Jackson’s lawyers and the judge said that Essence Jackson is constitutionally entitled to bond because she has no prior violent offenses that make her a danger to society, and the fact that she was arrested five days after the shooting at work, which her lawyers said demonstrates she was not evading police and wasn’t a flight risk.

“Everyone agrees that she is not the shooter,” said Essence Jackson’s attorney, Seth Rose. “So she’s 19 years old, an honor roll student, no prior record at all; she was arrested roughly a week later at work. But she’s clearly not a flight risk, she’s clearly not a danger to the community and she has a constitutional right to a bond.”

The repossession murder took place on June 10th, but prosecutors said the car had been moved several times to avoid being repossessed before then and that when Hughes came to get the car, Essence woke everyone up in the house, and her brother went outside to deal with it. Hughes was found shot in the head but was still breathing when Richland County Deputies arrived. The vehicle and several surrounding homes were found with bullet holes.

Miami-Dade, FL – September 5, 2024 – Cutting his hair, pawning the gun for gas money and fleeing state after firing on a repossessor, one man got far. But not for very long.

It all started back on July 31st at about 9:25 pm when Miami-Dade police officers arrived at a call at 400 block of Northeast 160th Terrace. It was there they met a repossession agent employed by Heat Recovery & Towing who had attempted to repossess a 2018 silver Lexus NX300 owned by 34-year-old Rony Guerrier.

According to the unnamed agent, he had spotted the car using LPR and was in the process of backing up to it and lifting it when he realized Guerrier was inside the car. Guerrier then emerged from the Lexus when the agent identified himself as a repossession agent and explained to Guerrier that the car was being repossessed at the request of the lender.

Police state the agent said that the situation then escalated and that Guerrier fired a gunshot. Wisely, the agent then retreated to his truck. Fearing more gunfire, the agent lowered the Lexus back down to the ground and began driving away.

But according to the agent, that wasn’t enough and as he was fleeing the scene, Guerrier chased him in the Lexus. It was then that Guerrier allegedly fired a second shot directly at the tow truck.

Police report that the tow truck was equipped with CCTV video, which investigators said captured the entire confrontation, including the gunfire.

Unfortunately, by the time the Miami-Dade police had arrived, Guerrier and the Lexus were long gone. Police report that the agent did not sustain any injuries and that his truck was not hit by any of the rounds fired during the incident.

Investigators quickly launched an investigation into Guerrier’s identity and whereabouts and entered his car into the national law enforcement database as a “felony vehicle,” the report stated.

A thousand miles and two days later, at about 2:45pm on Aug. 2ndSpeedway, Indiana police located Guerrier’s 2018 Lexus NX300 in the parking lot of an apartment complex where they took Guerrier into custody without incident.

Upon his arrest, police discovered that Guerrier had cut off his medium-length dreadlocks to hide his identity and even found a bag containing his cut dreads in the Lexus. In addition, a Los Angeles Lakers jersey that he had worn during the Miami-Dade shooting was found which only further confirmed his identity.

While the gun was not found in the Lexus or in his possession, investigators said they located 9mm ammunition and a holster. Guerrier later admitted to police that he had pawned the gun to finance his escape from Florida on August 1st.

The gun was recovered by police and identified as a 9 mm Glock Model 17 and is currently being held as evidence for forensic comparison with a 9mm shell casing recovered from the crime scene.

Guerrier is facing one count each of second-degree attempted murder, shooting or throwing a deadly missile and tampering with physical evidence.

Guerrier was extradited to Miami-Dade County to face prosecution and was formally arrested Wednesday. As of Thursday, he is being held at the Turner Guilford Knight Correctional Center, where his bond has not yet been determined.

Chicago Ridge, IL – August 21, 2024 – An attempted repossession at a window tint shop ended in gunfire, armed robbery and a hostage taken.

On August 20th at 1:21am, Chicago Ridge Police responded to a report of shots fired at Signature Line Motorsports at 10005 S. Harlem Ave.. Upon arrival, officers discovered that the shots had been fired at a repossessor attempting a recovery who had already fled the scene unharmed.

The alleged shooter, 26-year-old Mahyoub Dawabsha of Orland park, had reportedly after the shooting, then took another person at the scene into the shop at gunpoint where he proceeded to attempt to rob it.

Police from both Bridgeview and Chicago Ridge were eventually able to get inside the business and take Dawabsha into custody. The victim who was held at gunpoint was rescued unharmed.

Dawabsha was charged with felony aggravated kidnapping, armed robbery, two counts of aggravated discharge of a firearm, aggravated unlawful use of a weapon, and three counts of aggravated assault, police said.

Youngstown, OH – August 2, 2024 – Almost two years after shots were fired at an Akron based repossessor, the shooter is sentenced.

Back on September 29, 2022, then 19-year-old Darnell E. Jackson opened fire on an unnamed repossession agent and struck his truck. Fortunately for all, other than some rattled nerves, the agent was not injured.

Months had passed by without capture and Jackson thought he was off the hook. But the only thing behind him On December 16th were flashing police lights.

Heart racing; he was sure they knew he was holding, so he swallowed the drugs and pulled over. But this routine traffic stop turned out worse than he expected and his bad decision to open fire on a repossessor had caught up with him.

Soon after his arrest, he is said to have reported to the police that he was feeling ill as the results of the swallowed drugs.

Fast forward two years and Jackson is finally held accountable for his irresponsible actions of that night.

According to Jackson’s attorney Scott Cochran, Jackson, now 21, was at his brother’s house, along with others, when a person showed up “early in the morning and is taking one of the cars that is in the driveway. He thinks somebody is stealing it.”

But as it turned out, that person was a Repo Man there to repossess a car.

Another person fired a weapon too, but that person was never identified or prosecuted, Cochran said. “There’s weapons in the house. They think somebody is stealing their car. The shot goes through a side mirror off of the passenger side of the car being towed,” Cochran said.

Cochran told Mahoning County Common Pleas Court Judge John Durkin there was no “legal justification” for Jackson firing a gun at the person removing the car.

“But I do think there is a distinction between trying to shoot a person on the street over a drug deal or something like that, which is what many of these cases are about, and that’s not what this is,” Cochran said.

He said Jackson’s parents were in court Thursday, and Jackson is “one of the most respectful clients I have ever represented,” and he is “smart” and “capable of doing things with his life.” His brother was a homicide victim, and the case was tried in Mahoning County Common Pleas Court, Cochran said.

“He is acutely aware of what this cycle of violence we have in this community is because he and his family have been victims of that.”

He said Jackson’s decision making that day was “clearly the wrong decision,” but Jackson could “come out of prison and be a very productive person.”

Jackson said, “I’m still young. I’m living and learning, and I just hope I can overcome my situation.”

Jackson pleaded guilty Thursday to felonious assault and a gun specification and a separate aggravated drug possession offense for firing the gun on Plum Street just west of downtown Sept. 29, 2022. Some other charges were dismissed in exchange for his guilty plea.

The judge sentenced Jackson to 4 to 5.5 years in prison.

Prosecutors said they would not oppose Jackson being released on judicial release when the appropriate time comes. Judicial release is an early release from prison approved by the sentencing judge.

Kyle Hilles, assistant county prosecutor, told the judge the reason prosecutors recommended the 5 to 7 years was because shooting at the repossession worker not only could have been injured or killed, “but any stray bullets could have injured anyone else who was around.”

IND Repo Man Shooting Details Released

Mishawaka, IN – July 15, 2024 – Back on the 15th, an Indiana Repo Man was shot in the hand. Since then, details have emerged that identify not only a clearer picture of what happened, but the agent’s name as well as his shooter, the lender and the forwarder who assigned it.

The agent, now identified as Christopher Grillo, told officers that he and a woman were at a residence in the 220 block of Colfax Avenue to repossess a black Jeep Wrangler on behalf of Advance Asset Recovery Transport.

This company is owned by a Barry S. Yakim, the same as identified on the truck as BSY Enterprises. Extremely reliable sources report that the assignment was placed through MvTrac on a Capital One repossession assignment.

A probable cause affidavit filed by police, reported that on Monday, officers responded to shooting victim located at the Expo Gas Station at 601 N. Main St. in Mishawaka.

Upon arrival, officers discovered a black Ford F450 tow truck with bullet holes in the front driver’s side window, front windshield, steering wheel, and rear window.

Christopher had suffered a gunshot wound to his left hand. A Danyelle Grillo was also on the scene with Christopher.

Before being taken to the hospital, Christopher told officers they were at a residence in the 220 block of Colfax Avenue to repossess a black Jeep Wrangler on behalf of Advance Asset Recovery Transport.

Grillo reported to police that a man shot at them approximately five or six times while they were directly in front of the house. Police say multiple casings were later located near that area.

Christopher and Danyelle described the shooter as a heavy-set white man wearing a green shirt and blue pants.

Christopher believed the registered owner of the Jeep’s last name was Gilmartin. Danyelle stated they were there to repossess the Jeep from a man named Cory Gilmartin and that he was currently in custody in the county jail.

An officer then spoke with Christopher at the hospital where he told them he and Danyelle had loaded the Jeep onto their tow truck. They then stated that as they drove past 220 W. Colfax Avenue, a man ran into the street and fired.

It was then that Christopher was shot in the hand.

Christopher said he told Danyelle to call the police and dispatch then directed them to the Expo Gas Station.

Colten Gilmartin was identified as the brother of the Jeep’s registered owner and suspected shooter. With this, Police then surrounded the residence on Colfax Avenue and called Colten on the phone and managed to convinced him to come out of the house peacefully.

Colten’s mother and stepfather also came outside. Colten was found to match the given description of the suspect.

Court documents state, later, neither Christopher nor Danyelle was able to identify Colten from a photo array.

Armed with a search warrant for the Colfax Avenue residence, officers conducted a search in which they found items including a holster, packing slip for a Taurus handgun, two plastic bags of spent casings, and a black Taurus handgun case.

Documents state the Taurus handgun case contained two loaded 9mm magazines and a black Taurus G3 semiautomatic handgun. Police say the handgun box, gun, and ammunition had been wrapped in a towel and hidden between a bed and headboard in the basement.

Authorities then advised Colton of his Miranda rights and he stated he had been sleeping all night. Colten claimed at one point that night, he had a friend with him.

Colten then later told an officer he had been home asleep on the couch when his friend woke him and told him he was being robbed. Colten stated he then went outside and saw that his vehicle was gone.

Colten claimed that he saw a tow truck accelerate and travel directly towards him. He then admitted that he fired approximately 11 rounds at the truck and later gave his guns to his mother.

Colten Gilmartin has been charged with one count of battery by means of a deadly weapon, a level five felony, and one count of criminal recklessness, a level six felony.

The State of Indiana has requested the court to detain Colten until a bail hearing in open court, due to him being considered a substantial danger to self, others or the community.

Repo Agent Shot at AL Gas Station

Birmingham, AL – July 16, 2024 – An unnamed repossessor had just repossessed a vehicle from the 4600 block of 12th Avenue North Tuesday afternoon. Pulling away, he came under fire. Speeding away, he sought refuge at the nearby Shell station only to find he’d been followed and cornered. At least twenty-one rounds were fired on him before he found his way to safety.

At about 1:20 pm, the Birmingham Police Department responded to a ShotSpotter notification near 50th St. and Richard Arlington Junior Blvd., North. Upon arrival, they observed shell casings on the ground at that location.

Moments later, they responded to a call of a person wounded at a Fire Station. Upon arrival, they met the victim, an unnamed repossession agent with a tale to tell.

Police were told that the agent had repossessed a vehicle from the 4600 block of 12th Avenue North, just blocks from the Shell station.

According to the agent, as he drove away in the repossessed vehicle, he was followed to a gas station, cornered and fired upon. Regardless, he fled for safety at a nearby fire station and was eventually taken to the hospital with non-life-threatening injuries.

Police reported that an undisclosed number of people have been detained for questioning. One man was seen in handcuffs near the location where the car was repossessed, but his role was not yet clear.
