Important! Ford Motor Credit Recovery Contract
Dear ARA Members,
American Recovery Association (ARA) has a duty to protect and inform its membership when circumstances arise that could place recovery professionals at legal or financial risk. In that spirit, we are reaching out today regarding the current recovery contract issued by Ford Motor Credit.
ARA made a formal attempt to engage Ford in constructive dialogue regarding the indemnification language and other problematic terms in the contract. Unfortunately, Ford declined to participate, stating only that “this is the contract they have always used.”
While longstanding practices may explain how we arrived at this point, they do not justify agreements that expose agents to unreasonable liability. The recovery industry has evolved — legal interpretations have shifted, and agents today face increasing scrutiny, risk, and exposure when contracts lack clear and fair protections.
We strongly urge each member to consult with legal counsel before signing the Ford contract. It is essential that you understand the implications of the indemnification clause and other key provisions. If your counsel shares our concerns, we encourage you to contact Ford Motor Credit directly to express your position.
ARA remains firmly committed to advocating for contracts that are fair, transparent, and legally sound — agreements that protect both agents and clients. We will continue our work to ensure that recovery professionals are not left bearing unjust or disproportionate risk.
