For Repossession Agencies Seeking Inclusion in the Directory
BY SUBMITTING YOUR INFORMATION FOR INCLUSION IN THE DIRECTORY ON THE WEBSITE LOCATED AT www.CURepossession.com OR www.CUCollector.com (collectively, “CURepossession/CUCollector” or “the Website”), YOU, THE REPOSSESSION AGENCY (“AGENCY”), AGREE TO THE TERMS OF THIS HOLD HARMLESS AGREEMENT (“AGREEMENT”). IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT SUBMIT YOUR INFORMATION OR SEEK INCLUSION IN THE DIRECTORY.
Purpose of the Directory
CURepossession/CUCollector operates a directory listing of repossession agencies for informational purposes only, providing a platform where lenders, assignees, or other parties may discover and contact repossession agencies. Inclusion in the directory does not constitute an endorsement, recommendation, or guarantee of business by CURepossession/CUCollector.
Disclaimer of Guarantees
CURepossession/CUCollector nor its owner makes no representations, warranties, or guarantees regarding:
- Whether any lenders, assignees, or other parties will contact you based on your inclusion in the directory.
- The volume, frequency, or value of any business you may receive from lenders or other parties who access the directory.
- The licensing, financial stability, reliability, or legitimacy of any lender or party who may contact you through the Website.
The decision to engage with any lender or party contacting you through the directory, as well as all due diligence regarding their qualifications, creditworthiness, or compliance with applicable laws, is your sole responsibility as the Agency.
Hold Harmless Clause
By submitting your information for inclusion in the CURepossession/CUCollector directory and agreeing to this Agreement, you acknowledge and agree that:
- You assume full and sole responsibility for any and all interactions, transactions, agreements, or disputes arising between you and any lender, assignee, or other party who contacts you through the Website.
- CURepossession/CUCollector, its owners, operators, affiliates, employees, and agents shall not be held liable for any damages, losses, claims, lawsuits, or legal actions of any kind—whether direct, indirect, incidental, consequential, or otherwise—resulting from your inclusion in the directory, the lack of business generated therefrom, or your interactions with any lender or party contacting you via the Website.
- You agree to indemnify, defend, and hold harmless CURepossession/CUCollector from and against any and all claims, demands, liabilities, costs, or expenses, including but not limited to attorney’s fees, arising out of or related to your participation in the directory or your dealings with any lender or party who discovers you through the Website.
No Agency Relationship or Guarantee of Business
CURepossession/CUCollector is not a party to any contract, agreement, or business relationship between you and any lender or party contacting you through the directory. The Website does not act as an agent, broker, or intermediary, nor does it promise or imply any specific amount of business, referrals, or contacts as a result of your inclusion in the directory.
Agency Acknowledgment
By submitting your information, clicking “I Agree,” or otherwise proceeding with inclusion in the directory, you expressly acknowledge and agree that:
- You have read and understood this Agreement in its entirety.
- You accept full responsibility for conducting your own due diligence regarding any lender or party who contacts you through CURepossession/CUCollector.
- You waive any right to pursue legal action against CURepossession/CUCollector for any matter related to your inclusion in the directory, the absence of business, or your interactions with lenders or other parties.
- You hold CURepossession/CUCollector harmless from any and all legal actions, claims, or liabilities arising from your participation in the directory or your dealings with those who contact you through it.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of California, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Santa Clara County, California.
Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Acceptance
Your submission of information for inclusion in the CURepossession/CUCollector directory constitutes your binding acceptance of this Agreement. If you do not agree to these terms, you must refrain from submitting your information or seeking inclusion.
CURepossession/CUCollector reserves the right to update or modify this Agreement at any time without prior notice. Your continued inclusion in the directory following any changes constitutes acceptance of those changes.
